As tax controversy attorneys we have been schooled and experienced by 30
consecutive years in the art of advocacy. We are different from tax return
preparers, accountants, certified public accountants, financial planners, certified or
otherwise. There’s basically three reasons for this:
1) as a rule, those folks have not been trained in the art of advocacy. By
definition, that is the skill and manner with which facts, circumstances, events and
the law are compellingly interrelated and presented to persuade someone making a
decision to reach a conclusion that is good for you. It features intuitive ability,
riveting writing and speaks skills, technical training and experience in stressful
argumentative and contentious environments.
2) we are licensed to practice and represent taxpayers before all the court
systems, including tax courts, the respective Michigan state courts and federal
district courts, federal courts of appeals, etc. The others are not. That means we
have the power to seek assistance or outside review by the courts. Now, your
problem may not necessarily require the use of all those additional resources,
however there are circumstances where the perception of having that authority
lends extra credibility and weight to your position. And experience has shown this
can work to your advantage when you need it most, even if it reveals itself in only
subtle ways to help you get your challenge resolved expeditiously.
3) and for those who have been other than honest, have been accused, at risk
of it or for those who will possibly be investigated for violating the criminal tax law,
only an attorney can advise and represent them regarding their constitutional rights.
Certainly, there is always a mathematical component to evert tax problem. I mean,
you have to add things up to figure what may be owed against what could be
saved. But aside from that virtually all the rest of a tax challenge is based on facts,
circumstances, decisions actions and other events in your life, all of which in turn
lends itself to the art of advocacy. Those things just don’t calculate on a machine.
This is the reason why we not only enjoy referrals from the accounting and financial
planning community but represent those professionals in the challenges that face
them.
